Visa Denied for a Crime Involving Moral Turpitude? How We Secured Withdrawal of the Finding
A client from China came to our office after a U.S. consulate found him inadmissible based on a crime involving moral turpitude (CIMT). Although he initially sought help with a nonimmigrant waiver, our office first examined whether the inadmissibility finding itself was legally correct.
Instead of immediately pursuing a waiver, we submitted a LegalNet inquiry to the U.S. Department of State challenging the CIMT determination. Approximately six weeks later, the consulate withdrew the inadmissibility finding. The case illustrates why a careful legal review of a visa denial can sometimes reveal options beyond simply applying for a waiver.

Burden of Proof in Immigration Court and USCIS: Who Must Prove What?
Immigration cases do not all use the same burden of proof. In some situations, DHS must establish deportability, while in others the immigrant, applicant, or petitioner must prove eligibility for an immigration benefit or form of relief. The applicable standard can also change depending on whether the issue involves a USCIS petition, removal proceedings, asylum, cancellation of removal, or a possible statutory bar.
The article explains important standards such as preponderance of the evidence, clear and convincing evidence, and clearly and beyond doubt, and why understanding who carries the burden can directly affect how a case should be prepared. It also addresses marriage cases, asylum presumptions, returning green card holders, and situations where missing or unclear evidence may work against the applicant.
